
What makes a good assessment of mental capacity (30 September 2025)
The webinar offers an introduction to the history and development of the Mental Capacity Act (2005) and the Code of Practice (2007). It will explore issues including defining the specific decision, identifying and gathering the relevant information, identifying who the decision maker is, and understanding the concept of weighing up the relevant information including weighing up ‘in the moment’. The webinar will also discuss report writing styles.
Please be mindful that case law is ever changing. This webinar will explore case law that is up-to-date when the webinar takes place.
This webinar will be recorded. The recording will be available for 12 weeks after the live session.

Webinar presenters
Dr Louise Warren CPsychol AFBPsS
Dr Warren has delivered training to the Salomons Institute for Applied Psychology (2020-present) as an Associate Teacher on the Postgraduate Diploma of Clinical Neuropsychology (Adult) on various topics including Mental Capacity. She has also delivered mental capacity training to an NHS Trust as an external provider.
She is current Chair of the Mental Capacity Advisory Group and involved with the development of Best Practice Guidance published to support Psychologists competence and confidence in conducting mental capacity assessments. Dr Warren regularly conducts mental capacity assessments as a treating clinician, as an expert witness and also for the Court of Protection.
Dr Viki Teggart
Dr Teggart is a Consultant Clinical Neuropsychologist working in both NHS and independent practice. She is a Module Lead on the Postgraduate Diploma in Adult Clinical Neuropsychology at the Salomon’s Institute for Applied Psychology.
She is a current member of the Mental Capacity Advisory Group and author of a book chapter on assessing whether someone can act on their decision at the material time. She is particularly interested in promoting the meaningful use of mental capacity assessments to support people with multiple and complex needs.
Dr Emma Fowler
Dr Fowler is a clinical psychologist working in later life inpatient settings in Manchester. She regularly supports the completion of mental capacity assessments and best interest’s decisions with her settings. She provides the Mental Capacity Act teaching to the Lancaster Clinical Doctorate programme and has delivered training in local council and NHS settings on how to apply the MCA in practice. Dr Fowler is a member of the Mental Capacity Act Advisory group.
Dr Clara O'Brien
Dr O’Brien is a consultant neuropsychologist and clinical psychologist working with adults with neurological disorders, acquired brain injuries and stroke both within the NHS and in private practice. She regularly conducts assessments of mental capacity in NHS inpatient and outpatient settings, as an expert witness and for the Court of Protection. Dr O’Brien provides specialist teaching to DClinPsych trainees at the University of Surrey and as an Associate Teacher to the Saloman’s Institute of Applied Psychology. Dr O’Brien is a member of the Mental Capacity Act Advisory group.
